These Terms of Service (“Terms”) constitute a binding legal agreement between you (“you” or “User”) and The Wilmeowth Agency (“Agency,” “we,” “us,” or “our”), governing your access to and use of the website located at www.wilmeowthagency.com (the “Site”) and any services provided through or in connection with the Site (collectively, the “Services”). By accessing or using the Site or Services, you represent that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Site.
1. Eligibility
You must be at least eighteen (18) years of age and legally capable of entering into a binding contract to use the Site or Services. By using the Site, you represent and warrant that you satisfy these eligibility requirements.
2. Permitted Use of the Site
2.1 General Purpose
The Site is provided to furnish general information about insurance products and to enable Users to request insurance quotes and to communicate with the Agency. You may use the Site only for lawful purposes and in accordance with these Terms.
2.2 Prohibited Conduct
You agree that you shall not:
- Submit any false, misleading, inaccurate, or fraudulent information;
- Impersonate any person or entity, or misrepresent your affiliation with any person or entity;
- Attempt to gain unauthorized access to any portion of the Site, our systems, or any data stored therein;
- Interfere with or disrupt the operation of the Site or its associated servers or networks;
- Use any automated means, including robots, scrapers, or data-mining tools, to access, monitor, or copy any portion of the Site;
- Use the Site in any manner that could damage, disable, overburden, or impair the Agency’s operations or interfere with any other party’s use of the Site; or
- Engage in any conduct that violates applicable law or regulation.
3. No Guarantee of Coverage or Pricing
3.1 Informational Nature of Quotes
Any quotes, estimates, figures, or other information provided through the Site are:
- Furnished for informational purposes only;
- Non-binding and subject to verification and underwriting; and
- Subject to change based on further review of your information, applicable laws, and insurer requirements.
3.2 No Binding Effect
The submission of a quote request through the Site does not:
- Guarantee that any coverage will be offered or issued;
- Bind, commit, or obligate any insurer or the Agency to provide coverage; or
- Create or constitute an insurance policy.
3.3 When Coverage Is Effective
Coverage shall be effective only upon (i) completion of an application, (ii) approval by the issuing insurer, and (iii) issuance of a policy and receipt of the required premium.
4. No Professional, Legal, or Financial Advice
The information provided on the Site is for general informational purposes only and is not intended to constitute legal, financial, tax, or insurance advice. You should not rely upon the Site as a substitute for consultation with a licensed professional. You are solely responsible for evaluating your own insurance needs.
5. Electronic Communications and SMS Terms
5.1 Consent to Electronic Communication
By submitting your contact information through the Site, you consent to receive communications from the Agency by telephone call, text message (SMS/MMS), and email. Such consent is granted expressly by your affirmative acceptance of the consent checkbox accompanying the quote form.
Mobile information, including phone numbers and SMS consent, will not be shared with any third party or affiliate for marketing or promotional purposes at any time.
5.2 Description of the SMS Program
The Agency operates a customer-service text messaging program (the “SMS Program”) for the purpose of following up on quote requests, providing quote information, and facilitating ongoing customer service. By enrolling in the SMS Program through the consent checkbox on the quote form, you agree to these Terms as well as the terms set forth in Section 5 of our Privacy Policy.
5.3 Message Frequency and Rates
Message frequency varies based on your interaction with the Agency. You may reasonably expect between one (1) and ten (10) messages per quote request. Message and data rates may apply per your wireless carrier’s service plan. The Agency does not charge for messages it sends.
5.4 Opt-Out and Help Commands
You may cancel the SMS Program at any time by texting the word STOP to any message you receive from the Agency. After submitting STOP, you will receive one (1) confirmation message and no further messages shall be sent unless you re-subscribe. To request help or additional information, text HELP to any message or contact us at the information provided in Section 12.
5.5 Carriers
The SMS Program is supported by major U.S. wireless carriers. Carriers are not responsible for delayed or undelivered messages, and the Agency shall not be liable for any such delays or failures.
5.6 Eligibility
Consent to the SMS Program is not required as a condition of purchasing any insurance product from the Agency. You may request and obtain a quote by alternative means, including telephone or in-person communication.
5.7 No Sharing of Mobile Information
The Agency does not share mobile telephone numbers or SMS consent with any third party or affiliate for marketing or promotional purposes. Information collected in connection with the SMS Program is used solely for the purposes described in our Privacy Policy and is disclosed only to service providers necessary to deliver the messages you have consented to receive.
6. Third-Party Insurance Carriers and Services
The Agency works with third-party insurance carriers, underwriters, and service providers in the course of furnishing quotes and coverage. The Agency:
- Does not control the underwriting practices, policies, or decisions of such carriers;
- Is not responsible for the conduct, products, or omissions of any third-party provider; and
- Makes no representations or warranties regarding the availability or terms of any coverage such third parties may offer.
7. Disclaimer of Warranties
THE SITE AND SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE AGENCY DISCLAIMS ALL WARRANTIES, INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. THE AGENCY DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, TIMELY, SECURE, ERROR-FREE, OR THAT ANY INFORMATION PRESENTED ON THE SITE IS ACCURATE OR CURRENT.
8. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE AGENCY, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO (i) YOUR ACCESS TO OR USE OF, OR INABILITY TO ACCESS OR USE, THE SITE OR SERVICES; (ii) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SITE; OR (iii) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.
You assume all responsibility and risk for your use of the Site.
9. Intellectual Property
All content contained on the Site, including without limitation text, graphics, logos, images, photographs, software, and design, is the exclusive property of the Agency or its licensors and is protected by applicable intellectual property laws. You may not copy, reproduce, distribute, modify, republish, or create derivative works from any Site content without the Agency’s prior written consent.
10. Governing Law and Venue
These Terms shall be governed by and construed in accordance with the laws of the State of Oregon, without regard to its conflict-of-laws principles. Any action, proceeding, or dispute arising out of or relating to these Terms or the Services shall be brought exclusively in the state or federal courts located in Multnomah County, Oregon, and you hereby consent to the personal jurisdiction and venue of such courts.
11. Amendments
The Agency reserves the right to modify these Terms at any time in its sole discretion. Any amended Terms shall be posted on the Site with an updated “Last Updated” date. Your continued use of the Site following such posting constitutes your acceptance of the amended Terms.

13. Severability
If any provision of these Terms is determined by a court of competent jurisdiction to be invalid, illegal, or unenforceable, such provision shall be modified to the extent necessary to render it enforceable, and the remaining provisions of these Terms shall continue in full force and effect.
14. Entire Agreement
These Terms, together with the Privacy Policy and any other policies or notices referenced herein, constitute the entire agreement between you and the Agency regarding your use of the Site and supersede all prior or contemporaneous understandings or agreements, whether written or oral.
